
At their May 21st meeting the Board of Health approved a notice of violation letter to be sent to STR operators who are currently advertising their homes for rent (on online or other media), have not yet registered with the town and who have already been notified to do so, without a response to the town. This letter will be the first step in town enforcement action. Nantucket Together fully supports this action and encourages vacation rental owners to annually register or remove their rental postings and let the town know they are no longer renting.

In a May 18 decision, the AG confirmed the legal passage of Article 1 (a citizen's article submitted by Fishing Charter Captain Brian Borgeson, requiring a 2025 Special Town Meeting) which permits by right, long and short term rentals in all zones. The challenge from an anonymous client was denied.

Since launching its local STR Registry, the rules regarding operation and ownership have been tightened to exclude all but those whose named owners are 'natural persons'. This has allowed some corporate-owned STRs to legally register. Is this a minor loophole or a continued neighborhood concern? The Nantucket Current investigated and the Board of Health responded with proposed amendments to their regulations (Chapter 338) which have now been approved for enforcement starting during this fall's STR registraton renewal process. During Tuesday night's Special Town Meeting, Article 1, which legalizes short-term rentals (STRs) by right across Nantucket, was passed by a vote of 1045 - 421, clearing the two-thirds threshold needed for adoption with 71 percent support. The passage of Article 1 was the culmination of a divisive five-year debate over whether to restrict short-term rentals, and essentially kills existing legal challenges of STRs on Nantucket........"

The Nantucket Association of Real Estate Brokers (NAREB) commissioned an independent study by the UMass Amherst Donahue Institute of vacation rentals that are managed by local real estate agencies. NAREB collected rental data from participating agencies for the period of 2019-2022, removed duplications and personal information and turned it over to the Donahue Institute for analysis and they published their report in June 2023.
